Im not familiar with Navitas controller, but I assume the electronic brake is being controlled by it - otherwise if its wired direct to a pedal switch, I'd expect the behavior you see.
Are there any settings in the controller you need to adjust? Like position hold timings, brake engage times, etc. You would expect the controller to wait for 0 MPH before engaging the parking brake.
