Having a similar issue with my 2010. When you lightly press the pedal just enough to get it moving does it jitter like its locking up?

yes. it rolls freely in "tow mode" so nothing is locked up

When you put it in tow mode it completely disengages the brake (so that makes since). Don't know if your aware, but these RXV's dont have traditional brakes. It has an armature on the other end of the AC motor that acts as the brake. My fiancee was driving ours the other day and it started doing this same thing. She tried to keep driving it and it started smoking at the brake. So the brake was clearly locked up. I had to leave work and tow her home. This seems to be a common problem with these. It has something to do with the brake losing voltage while driving causing the brake to think it is being activated. Thus locking the brake up while still accelerating. I have seen a couple of pictures of the brake destroyed inside from these lockups.

Mine is going to the dealer in about two hours and he says its a 15 minute fix . I will keep you posted.

If it always goes the same (low) speed, it might not be the brake. Since it unlocks just fine in tow, lets not replace the brake just yet.

Agreed, my dealer says he has seen it before. He thinks its just a brake sensor, that being said I have seen multiple threads that state otherwise.....guess we will find out in a couple of hours
