Default RXV In-line Fuel Filter

Should the In-Line fuel filter always have gas inside? My filter drains when my cart is not being used and never does fill more then about a third when I am running. I also sometime have to use the choke even when the engine is warm. I changed the filter and still the same. Is this right?

Mine seems to have some air in it at all times too.... as does my honda v-twin mower.
