Golf Cart Restrictive Covenants
Hey Guys,
I live in a new sudivision that is still under construction (1st phase complete). A few of us have purchased golf carts and use them to travel to each other's houses, the pool during the summer, and just cruise the neighborhood in general..... Well, as you can imagine, some don't like the idea for some unknown reasons. I would like to submit an ammendment to our restrictive covenants that specifically allows them before these jackwagons have them banned. If you belong to a community that allows the use of golf carts within the subdivision, I would like to see the portion that deals with them directly. *I am not interested in any comments/oppions about your views on restrictive covenants..... I already know the pros and cons..... LOL Thanks! George |

What do your CC&R's say now?
If they do not restrict them its not like the "Jackwagons" can just wave a magic wand and get them banned. It is quite likely the dveloper still controls the association. You would need to read the by-laws to see where you stand and what has to be done to specifically approve or exclude them in the CC&Rs. |

Check with your state to see if they have a street legal provision for golf carts. If they do, get the golf carts up to legal standards, get the sticker or license plate (Which ever your state requires), and they can't tell you that you can't legally drive your STATE APPROVED, LEGAL TO DRIVE Low Speed Vehicle on a public road.
You might have to fight with the HOA about it, but in the end they will loose! It's like them trying to say that you can't drive a pickup truck or a SUV in your neighborhood because they don't like them. A newer neighborhood down the road that a friend of mine lives in tried just what you are talking about and got sued over it when they started mailing out fines for golf carts and threatening foreclosures. The HOA lost and had to pay the home owners back every fine they wrote and got read the riot act by the judge presiding over the case. I know because I was there when it happened, and almost got thrown out of court when I started laughing at the "I'm better than you" HOA members. Now if you're in a GATED community with private roads, this won't work for you and you'll have to get the amendment to allow Low Speed Vehicles written in. Either way, get the carts street legal with mirrors, lights, brake lights, turn signals, and seat belts. The people complaining shouldn't have a leg to stand on since you'll be basically driving a slower version of the Toyota Prius. Hope this helps, -Scott H. |

I will also add to what Scott H. said because that is how everybody got around it in my neighborhood. My HOA also requires that we notify them we have a golf cart and it must be street legal but does not have to have a license plate. However, if you have kids, they must have a license if they are driving a golf cart that has a street legal plate on it. Without a plate they can be 14 in FL I believe.

What about using the ADA/Handicapped angle? Generally speaking, when this is used, people are very reluctant to buck against it (lawsuit and VERY bad press), so you might want to try this method...just my .02
